Pursuant to Article 3 of Law No. 6563 on the Regulation of Electronic Commerce (the "Law"), all identifying information regarding Uludağ Kayak Merkezi Turizm Sanayi ve Tic. A.Ş. ("Uludağ A.Ş.") is kept up to date in the "About Us" section of our website and is, by way of reiteration, set out below;
General Provisions
This Sales Contract also constitutes the Terms of Use and the privacy principles. By becoming a member of our website and/or carrying out ticket purchase transactions, you acknowledge that you have read and understood the Terms of Use, the provisions of the Sales Contract and the Privacy Statement, and that you shall be deemed to have accepted their contents in full. By purchasing a ticket from our website and confirming your order, you accept that you are bound by the provisions of this Contract. Accordingly, we emphasize that when you purchase a ticket from our website, the provisions of the Contract set out below shall apply in full to the entire process, procedures and transactions relating to the tickets.
Furthermore, by confirming your order, you acknowledge that, prior to purchasing the ticket;
- all necessary information regarding our company and its contact addresses,
- all the features relating to the ticket and service you have purchased, as well as the total ticket/service price including all taxes and any additional charges,
- the information regarding payment, delivery and performance, and the dispute-resolution methods set out in the contract concerning complaints,
- the contractual information that you may bring your applications regarding disputes before the Consumer Court or the Consumer Arbitration Committee,
- that, pursuant to Article 15 (g) of the Distance Contracts Regulation, you have no right of withdrawal and that, consequently, you are aware of all the provisions set out in the contract,
have been provided to you, and you hereby accept, declare and undertake the foregoing in writing. We further and importantly emphasize that, within the scope of your consent, preliminary information consent has been obtained from you in writing prior to confirming your orders, and that the preliminary information consent constitutes an integral part of this Contract. In addition, we wish you to know with particular importance that, through this contract and the preliminary consent, you have been clearly and comprehensibly informed that "in the event your ticket purchase order is confirmed, you shall incur a payment obligation."
Terms and Conditions Relating to Tickets
1. Personal Use and Commercial Prohibition
The person purchasing the ticket declares and undertakes that they have purchased the ticket without any commercial purpose, exclusively for their personal use, and that, save where express written permission is granted, they shall not use the ticket for any commercial business or activity. The purchased ticket may not be sold to third parties in any manner whatsoever, nor may the ticket be offered for sale at an additional charge or otherwise; the purchased ticket may not be used for promotional or other commercial purposes, including but not limited to advertising, competitions and prize draws. The sale or attempted sale of the ticket at a price different from the price stated on it shall constitute just cause for the authorities to confiscate the ticket and/or cancel it, without any refund being made and without entitlement to any other claims.
2. Right of Unilateral Cancellation
If we determine that this rule has been breached in any manner, whether the ticket purchase was carried out using multiple cards or through the card usage of members of the same household, Uludağ A.Ş. reserves the right to unilaterally cancel the purchased tickets without prior notice.
3. Sales Channel and Season Card Registration
Tickets are sold via the internet. Tickets may sell out, be closed to sale, or additional tickets may be reopened for sale. Purchased tickets shall be registered to the person's Season card after the purchase transaction is completed. You are responsible for the control and safekeeping of the tickets sold and registered to the Season card.
4. Courier Delivery
If you select the "courier" option as the delivery method for the tickets you purchase, please ensure that the address and the information of the person receiving the delivery are correct in order to avoid any delivery problems. The courier fee is charged to your credit card, provided that you are informed of the "courier fee" during the purchase transaction. Delivery cannot be made if you provide an address outside the delivery zones. A Mail Order request Form or a Delivery Form may be required to be signed at the time of delivery.
5. Responsibility for Safekeeping of Tickets
You are responsible for the control and safekeeping of your tickets. Please note that tickets may be damaged and rendered unusable due to direct sunlight or heat, and keep them in a safe place. Uludağ A.Ş. shall in no way be liable for tickets that are lost, stolen or destroyed in any manner whatsoever.
6. Absence of the Right of Withdrawal and Refund Policy
As a rule, all ticket sales are final. Pursuant to Article 15 (g) of the Distance Contracts Regulation, you have no right of withdrawal with respect to the tickets you purchase. In the event that sold tickets are lost, stolen, damaged or destroyed in any manner, no ticket replacement/reissue or refund shall be made. Sold tickets may not, in any manner whatsoever, be cancelled, exchanged or refunded after the sale transaction. In cases where Uludağ A.Ş., at its own discretion, grants a refund, the refund amounts shall be limited to the refund value stated on the purchased ticket, and no other amount may be claimed.
Apart from the absence of the right of withdrawal under Article 15 (g) of the Distance Contracts Regulation, tickets to be sold in advance are also strictly non-refundable on account of their being offered at a favorable price. Even where there is no favorable-priced or advance sale, tickets cannot be refunded even due to bad weather or the closure of the facilities or their early closure.
Tickets referred to as point-based tickets have multiple-use capability, and this point-based ticket type may be used by 23 different persons. However, ticket types designated as daily, seasonal and the like shall be blocked as soon as it is determined that they have been used by more than one person, and no refund shall be made.
The holder of tickets registered to a specific individual definitively accepts that, in the event of sharing with second or third persons during the season, if the tickets are detected by the system, the ticket shall be cancelled, the ticket shall remain completely closed throughout the season, and they shall be unable to use the seasonal ticket type again during the current season.
Only in the event of injury, and on condition that a doctor's report is submitted, another ticket may be issued to be used for any 1-2 days during the season (corresponding to the number of days unused) and delivered to the customer for use either by themselves or by their family. Furthermore, even in the event that the facility and the tickets cannot be used due to any local or nationwide precautionary measures to be taken by administrative and judicial authorities, or due to pandemic and epidemic processes, you have no right to claim a refund or reduction of the ticket fee.
Should Uludağ A.Ş., at its own discretion, decide to grant a discount, refund or improvement in this regard, it shall notify you by appropriate means.
7. Ski Area Rules and Camera System
The tickets and/or the conditions for purchasing the ticket apply to all Uludağ Ski Areas managed by Uludağ A.Ş. The 46 turnstile entrances located at the entrances of 22 different mechanical facilities are within this scope. All these areas are organized in accordance with the rules of Uludağ A.Ş. In the event that you breach any of these rules and regulations, or cause damage or disturbance, or engage in unlawful and/or potentially criminal conduct, Uludağ A.Ş. has the right to remove you from the ski area or to refuse your admission to the premises.
Security searches may be carried out from time to time within the area in order to ensure your safety. Furthermore, on security grounds or for other reasons, it reserves the right to refuse to sell tickets to customers whose personal information is not available.
Since the tickets are sold exclusively to the individual customer, the customer is aware of and accepts that a camera system has been installed that will photograph all passages at the turnstiles. Both for security purposes and to determine that the tickets are not being used by another person, a photograph will be taken at each ticket reading at the 46 turnstiles installed at Uludağ by a total of 20 cameras and verified via the server, and this ticket will be blocked "if necessary." Accordingly, if you do not wish your personal information, including the photograph, to be shared with Uludağ A.Ş, then since Uludağ A.Ş has the right to refuse to sell you a ticket, you must carefully read the Privacy Statement, which is an integral part of this contract, before completing the order and purchasing the ticket.
8. Use of Equipment
The use of cameras, mobile phones or recording equipment is subject to the rules and regulations established by Uludağ A.Ş.
9. Pets
Uludağ A.Ş may prohibit pets from being brought into the area.
10. Outside Food and Beverages
Uludağ A.Ş may prohibit customers from bringing food and beverages from outside into the premises.
11. Responsibility for Personal Belongings
Uludağ A.Ş. assumes no responsibility whatsoever for customers' personal belongings.
12. Right to Sell Tickets
Uludağ A.Ş. reserves the right to sell any ticket, including seasonal tickets, at a discount, without a discount, or not to sell it at all.
13. Detection of Sharing
In the event that Uludağ A.Ş. determines that the tickets it has sold are being shared with other persons, it reserves the right not to sell tickets again.
14. Limitation of Liability
Uludağ A.Ş. is under no other obligation, undertaking or liability with respect to the tickets, other than the amount stated on the ticket and the relevant service fee. You shall be deemed to have accepted, declared and undertaken in advance that the liability of Uludağ A.Ş. is limited by this article and that, under whatever name it may be, you shall not hold Uludağ A.Ş. liable beyond the limitation of liability set out in this article.
15. Commercial Electronic Communications
Commercial electronic communications within the scope of the Contract may be sent to you, provided that your consent is obtained in advance. Furthermore, you have the right to refuse to receive commercial electronic communications at any time, without stating any reason. On the other hand, we note that where you provide contact information for the purpose of being contacted, no separate consent shall be obtained for commercial electronic communications relating to changes to the services provided and/or to their use.
16. Retention of the Contract
This contract text is, following the conclusion of the contract, retained in the data records of Uludağ A.Ş., and if you wish, you may also easily access a physical copy by printing out the contract. Accordingly, we wish you to know that the means have been provided for you to easily access and retain the provisions of the contract and the general terms and conditions.
17. Privacy Statement
The privacy rules relating to the use of our website and to this contract are set out in detail. In this regard, we bring to your attention that you should carefully read and review the provisions of the Privacy Statement, and that you should notify us if you have any other requests. The Privacy Statement is an annex to and an integral part of this Contract, and shall apply and take effect together with the Contract in full.
18. Order Confirmation
At the stage of confirming the order and before entering the payment information, all the terms of the contract, including the total amount you will pay, are clearly visible to you. Accordingly, we reiterate that by purchasing the ticket and confirming the order you shall be deemed to have accepted the provisions of this contract in full, and we remind you once again that you should carefully review all the provisions of the contract before confirming the order.
19. Security of Personal Data
Uludağ A.Ş. is responsible for the storage and security of the personal data obtained about you. Furthermore, we note that your personal data may not be transmitted to third parties without your consent and may not be used for purposes other than those notified to you.
Competent Court and Disputes
These terms and conditions are, in their entirety, subject to Turkish Law. Uludağ A.Ş. has informed all consumers in advance regarding the provisions and content of the contract before you purchase your ticket; and we note that, by purchasing the ticket and confirming the order, you shall be deemed to have accepted that preliminary information regarding the provisions of this contract has been provided to you, and that this article serves as a means of proof in the nature of written evidence.
In the event of any dispute arising out of this Contract and/or the service or ticket purchase transactions, our fundamental objective is, first and foremost, to seek to resolve the dispute amicably. Nevertheless, in cases that cannot be resolved amicably, we wish you, the consumers who purchase tickets from our website, to know that you may bring your potential issues before the Consumer Arbitration Committees and/or the Consumer Courts within the framework of the monetary limits published in the relevant legislation. Furthermore, we note that in all disputes arising from the contract, the Courts and Enforcement Offices of Bursa shall have jurisdiction, and that this provision is in the nature of a "jurisdiction agreement."
